I'm not sure if this carries any weight but the Scottish courts have been advised not to interfere with Parliament reviewing the proposed deal on Saturday.

From the article it looks like the presiding judge wasn't happy about what he saw as an attempt to disrupt Parliament and I'm inclined to agree that the lawyer arguing that the deal is unlawful was being disengenuous in saying the government just has to repeal the relevent amendment since that can't be done quickly.

That said the law is the law.

Cassie

Ha the guy bringing this law suit has asked 'what's the rush'. Where has he been for the last 3 and a half years?

Cassie

I'm not fully aware of the consequences of the agreement but it looks as though it's a non-goer according to that law.

They are making use of Mr Rees-Moggs ammendment which he used to block the draft Irish backstop. If the government can repeal the amendment the issue goes away but I don't know how easily or quickly that can be done.

It's somewhat embarrassing for the Government that they have agreed a deal which their own Leader of the House of Commons rendered unlawful before it had even been agreed.

I didn't know that. Shoot and foot comes to mind.

It appears that particular bill dates back to the 8th September 2018 so I suspect they just forgot about it.

This does however opens the door to speculation over whether it was a case of simple incompetence or if Mr Rees-Mogg or someone else was aware but kept quiet in the hope it would be noticed and used to disrupt Mr Johnson's efforts to secure a deal.

Either way it doesn't look good for the government.

How do they get these things through the courts so quickly?

It may be that Mr Rees-Mogg's ammendment to the above (https://researchbriefings.parliament.uk/ResearchBriefing/Summary/LLN-2018-0089#fullreport">https://researchbriefings.parliament.uk ... fullreport">https://researchbriefings.parliament.uk/ResearchBriefing/Summary/LLN-2018-0089#fullreport) to include the below statement would make Ireland remaining within the Customs Union unlawful?

(1)It shall be unlawful for Her Majesty's Government to enter into arrangements under which Northern Ireland forms part of a separate customs territory to Great Britain.

It appears an injunction is being applied for regarding this to stop the deal from being put before parliament (https://mobile.twitter.com/JolyonMaugham/status/1184530270478913538?s=20">https://mobile.twitter.com/JolyonMaugha ... 13538?s=20">https://mobile.twitter.com/JolyonMaugham/status/1184530270478913538?s=20) unless the above is repealed by parliment.

Do you think this will pose a further barrier to Mr Johnson's proposed deal? I don't know how quickly parliment could repeal that bit or whether it would be willing to do so.

The great thing about taking back control is you can change your laws, if that's what the country wnats to do then the laws will change
