Every person attending at the counting of the votes shall maintain and aid in maintaining the secrecy of voting and shall not—

(a)ascertain or attempt to ascertain at the counting of the votes the number [or other unique identifying mark] on the back of any ballot paper;

(b)communicate any information obtained at the counting of the votes as to the candidate for whom any vote is given on any particular ballot paper.

It depends on whether his statement could be considered "communicating any information" - he certainly implied it was going well for him which is information as to whom any vote is given that he would have obtained at the counting of the votes



The penalty is serious, big fine and potential jail time.



He might just get away with it though. As he didn't reveal who a particular vote was for, just the overall "shape" of the votes.



Irrc a (possibly labour) candidate was caught doing a similar thing (albeit more seriously as she posted some numbers) about 10 years ago.

Quite, Tory dirty tricks banned from internet providers, they have also lost their complaint about the block of ice representing Boris.

Produced a dirty tricks manual to be used against Labour candidates tailored for each constituency.

If they are taking such desperate measures they could end up putting Corbyn into number 10 not keeping him out of it.

He's not supposed to comment on the postal vote results since it could influence the voting on the 12th December but did so anyway.
